alright guys sorry for making you read this but I need to A. Vent and B. gain some legal perspective C. Get some good leverage tactics

My town was built no joke in the 1600's and has all victorian houses in it. Therefore a very select few of the houses in the town itself have driveways. The town has a parking lot near my house to which you must apply for a parking space, and pay $25 a month to park there. I waited for over a year to get a parking space down there and still have to pay to use it. Because the houses are so old the town regulates any changes to the landscape and very rarely allow the construction of driveways. As of next week, they are taking away all of the allotted parking spots and assigning one spot per household (My family has 5 cars). The police issue tickets for parking on the street, and the church across the street tow's cars that are parked there for non-church use. This is gonna force me to sell my camaro since I will have no place to park it (not registered or insured anymore), and god only knows where I'm going to be able to park my talon. What do you guys suggest I do to try and fix this problem? There has to be some kind of legal way around this but I cant figure it out (i'm only in my second year of criminal law :cry: ). Maybe we can hold a car meet in my town and go for a nice cruise down the one way streets of my nice quiet little pos town. It echo's nicely, I got yelled at for knocking picture frames off the walls of my neighbors with my camaro :lol: , maybe we can set something up?

Well, there is nothing that says you can't park a car on your property. Granted, the government owns 3 feet of property off the street, but other than that, I've never heard of such a thing "the town regulates your landscape". I would be interested to hear what an attorney has to say.

yea its the same principal as like shore towns regulating how long the grass on your lawn is and stuff. It's considered a historic town, so all changes that normally have to be ok'd through the town are further restricted. Certain towns have regulations as to what color they can paint their house and so forth. Some bs about maintaining the integrity of the character of the town or something.... god this is really bothering me

the more i think about it, the more parking on my front lawn is looking better and better. Technically we wouldnt be building anything, so the town doesnt have to approve it. It would look so white trash and horrible parking on front lawns that i'm sure they would get pissed (great leverage). I mean they have been charging $25 a spot per month with approximately 80-90 spots in the parking lot. They should have taken that money they made for the past 60 or so years and build an alternate parking lot next to it.

Exactly... and there is no law that says that a registered/insured car can't sit on your property. It's those project cars (I'm one to blame) that sit and sit that don't follow the states guidelines.

Check here for the Parsippany / Troy Hills local and state laws/ordinances.

Well as long as the car isnt really ghetto then they probably wont bother you about the car on te lawn thing, however i dont really know much about the town. In some towns if the car is really ghetto the town will force you to move it as it is an eyesore and "takes away from the town".

here is the regulations on the parking taken from the link greg posted... thanks again....:
(6) Inoperable motor vehicles. No inoperable or currently unregistered or uninspected motor vehicle shall be parked, stored or left on any residential, multifamily or shopping center property except inside a garage or enclosed building.
(7) Parking of motor-vehicles. (a) The parking of any motor vehicle by an owner, occupant or operator on the lawn of any residential property is strictly prohibited.
(b) All vehicles must park on an improved surface, either paved by asphalt or similar-type material or stoned as a parking area in accordance with the requirements of Chapter 225, Land Use, Subdivisions and Site Plans.

basically i would have to cover my front lawn in stones to park on it...

Do they say anything against putting down a driveway in the ordinances? If not, do it.... even if its' just 2 rows of crushed stone. It's better than nothing.

unfortunetly for anything like that you would need site plan approval, which would most likely get knocked down. Even if it is a gravel driveway that does not increase impervious coverage.

I hear you greg, towns are never fair nor do they ever display common sense. I mean what household has only one car?

well we used to be under the control of Mount Tabor, but as of recently control was split between Parsippany Troy Hills and Mount Tabor. Aka our taxes get split between the two and the duties of the town are also shared. Apparently one of things Mount Tabor remains control of is the parking lot, while Parsippany has the roads and general concerns. Not only are the limiting the spaces to one per household regardless of the number of occupants or houses, they are still charging the $25/month fee to park there, AND a yearly tax to have it plowed in the winter. Basically bending us over and making us pay for it lol. The thing that is confusing is that the majority of ordinances are covered by Parsippany, but is regulated and governed by both governments, so its tough to decide which one to complain to. They each will probably place the blame on the opposing party and make it impossible to get anything done. major suck

I found that I can apply for a permit to park on the street in front of my house, but what are the chances I will actually be granted that request? Parking is restricted on my street from 2am-6am (basically the only time I am actually at home, between class/work/partying)

My family owns 5 cars in total. My camaro/talon, my father's trailblazer, my mother's town and country, my brother's intrepid, and my sister will be getting her permit in less than a year. Because of trees, walkway's, retaining walls etc. the property really isnt big enough to fit 4 additional cars on the lawn, if they even let me park them there!

my father used to be the President of the town and I know all of the members of the board personally, so I might go to each of them and raise some hell individually before I go bitch them out at a public meeting. I swam in the Mayor's pool for christ sake! I dont care if I make a fool out of myself in doing so, I'm gonna fight this to the end, no way am I going to walk 2 miles to get my car every morning b/c I have to park it across the highway in a foodstore parking lot or something. Its just not gonna happen

no solution yet... I need to read every single freakin code to try and come up with a legal reason why they cant do this or some way to get them to build a new lot. Either park on my lawn or try to get them to build another parking lot on the opposite side of the town and split the town in half to park in either designated lot. It's almost 5 and these tools are almost home from work, time for me to start bashing skulls in person... i'll let you know how it goes

Those parking restrictions blow, especially since you are not given any alternatives (i.e. driveways, garages, etc.) Not sure why you are the only one up in arms about it. I would think that everyone in the town would be upset. If so, time to elect new zoning board members. If not, maybe its time you think about moving to a less heavy handed town.

yea well i'm certainly not the only one that opposes this, however, the majority of the people on the council live on the complete opposite side of town where the houses are much more modern and were built with driveways (before the historic regulations came about). One of these happens to be my aunt, who got such a lecture from me today that she just stopped talking all together and said it will be reviewed (complete bs). I also spoke with the town maintenance manager since i used to work for him back when I was 16, and he in turn called the town president at work who apparently put my father in charge of an alternate planning committee to change the issue. At least i'm making some kind of waves here. I think this was just one of those issues that they figured no one would hear about and pass it right over our heads before anyone knew what was really going on. Tomorrow I'm heading over to the Mayor's of Parsippany's house (a block down the street) and probably going to town hall to apply for a parking permit for the street. And yea, I'm looking at selling the camaro. I played around with it today, and it still will not start, i'm assuming dead batter or starter or something since it hasnt been moved in almost a year. I originally wanted a grand for it, but honestly now that I know about this stupid parking lot bs I gotta get it out of there, i'll sell it dirt ass cheap.

Many towns require cars to be parked on an "approved surface". Basicly, if it's not on the prints for the house or on a permitted additional area, you still can't park there.
